End User Licence Agreement

1. This agreement

This End User Licence Agreement (the "Agreement") is between you and T3 Sixty LLC ("T3 Sixty", "we", "us"). It governs your use of The D.A.N.G.E.R. Report (the "Report"), including the PDF made available for download on this site, and the text, data, design and code published on dangerreport.com (together with the Report, the "Materials"). By downloading the Report or using the Materials you accept this Agreement.

2. Background and rights

The Report was commissioned by the National Association of REALTORS® ("NAR") and was researched and authored by Stefan Swanepoel. It was published in 2015 by RealSure, Inc. and NAR (ISBN 978-0-9863779-9-0). RealSure, Inc. was rebranded as T3 Sixty LLC in 2017, and T3 Sixty LLC is its successor in respect of the publisher's rights in the Report. T3 Sixty grants the licence in this Agreement in respect of those rights.

We acknowledge NAR as the commissioning body and as the party named in the copyright notice printed in the Report itself, and we acknowledge NAR's rights and its REALTOR® trademarks. Nothing in this Agreement limits, waives or purports to grant rights held by NAR, and nothing here should be read as NAR granting you anything. Where you need rights beyond those granted below, you should seek permission from both T3 Sixty and NAR.

3. Licence granted

Subject to your compliance with this Agreement, we grant you a personal, non-exclusive, non-transferable, revocable, royalty-free licence to:

• Download, read and store the Report for your own use, including internal use within your organisation.
• Print copies of the Report for that same use.
• Share the Report unmodified and in full, free of charge, with colleagues and members of the real estate community — the Report was published to be distributed at no cost, and that remains our intent.
• Quote short extracts in commentary, training, research, journalism and presentations, with attribution as set out below.

4. Attribution

When you quote or reproduce any part of the Report, attribute it clearly. For example:

The D.A.N.G.E.R. Report, researched and authored by Stefan Swanepoel, commissioned by the National Association of REALTORS®, 2015.

Do not present the Report's findings as your own work, and do not attribute quoted opinions to any named individual — the underlying interviews were given in confidence and no input in the Report is attributed to any particular person.

5. Restrictions

You may not:

• sell, licence, rent or otherwise charge for the Report or any part of it, or include it in a paid product or paywalled resource;
• modify, adapt, translate or create derivative works from the Report without our prior written permission;
• republish the Report in whole on another website or platform, or host your own copy of the PDF for public download, rather than linking to this site;
• remove, obscure or alter any copyright, trademark, authorship or other proprietary notice in or on the Materials;
• quote extracts out of context, or in a way that misrepresents the Report's findings, its 2015 publication date, or its forward-looking and hypothetical nature;
• use the Materials to imply that T3 Sixty, Stefan Swanepoel or NAR endorses you, your organisation, or any product, service or position; or
• use the Report or its data to train, fine-tune or ground a machine learning or generative AI system, or to build a competing dataset or derived product, without our prior written permission.

6. The website, dataset and code

This website — its design, the structured danger dataset compiled from the Report, and the underlying source code — is a separate work owned by T3 Sixty. It is not open source and no licence to it is granted by this Agreement beyond ordinary use of the site as published. Linking to any page here is welcome and requires no permission.

7. Reservation of rights

All rights not expressly granted in this Agreement are reserved. This Agreement grants you a licence only; it transfers no ownership in the Materials to you.

8. The Report is historical

The Report was published on 14 May 2015 and has not been updated. It concerns hypothetical future events that may or may not have occurred, assessed against conditions as they stood in 2014–2015. It is provided for reference and discussion, not as current guidance. See the Terms of Service for the full disclaimer.

9. No warranty

The Materials are provided "as is", without warranty of any kind. To the fullest extent permitted by law we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, and make no representation or warranty as to the accuracy or completeness of the Materials.

10. Limitation of liability

To the fullest extent permitted by law, T3 Sixty and the Report's authors, editors and publishers will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising from your use of or reliance on the Materials.

11. Termination

This licence terminates automatically if you breach it. On termination you must stop distributing the Report and destroy or delete copies held for distribution. You may keep a single copy for your own reference. Sections 7, 9, 10 and 13 survive termination.

12. Requesting broader permission

If you would like to do something this Agreement does not allow — translate the Report, build on its dataset, include it in a commercial product, or reproduce it at length — write to us. Permission is often given for research and educational use.

13. Governing law

This Agreement is governed by the laws of the State of California, United States, without regard to its conflict of laws rules, with exclusive venue in the state or federal courts located in Orange County, California.
